The short answer
No wholesale-disclosure statute — but buy from a distressed owner-occupant and Colorado's Foreclosure Protection Act makes you an 'equity purchaser' with hard duties. Below is the plain-English version of the rules Wise Revival operates under in Colorado — assignment, disclosure, licensing, and marketing — taken from the statute material reviewed through our legal gate.
Assignment: what the law allows
- Colorado has no wholesale-disclosure statute; the broker line is acting FOR ANOTHER (dealing in options for others is broker activity). Wise Revival's deals are purchase contracts that may be assigned — never option flips.
- The exception swallows deals that touch distress: buy from a distressed owner-occupant and a different body of law takes over — see below.
Disclosure and licensing requirements
- Under the Foreclosure Protection Act (C.R.S. §6-1-1103), a buyer who buys directly from an owner-occupant who is 30+ days delinquent or in foreclosure is an 'equity purchaser.'
- Equity purchasers owe a written contract meeting §§6-1-1111/1112, a cancellation right for the seller, and a hard standstill during the cancellation window — no deed, no recording, no transfer or ASSIGNMENT, no payment (§6-1-1117(2)).
- Violations are criminal (§6-1-1118).
Marketing: where operators get in trouble
- Translation: in Colorado, a novation or assignment during the standstill is barred. Structure distressed-owner deals to close, not to flip the paper.
- The standstill reaches marketing steps operators take for granted — no transfer or assignment of any kind during the cancellation window.
The Colorado operator checklist
- Ordinary deals: purchase contract as principal; assignment is contract business, options-for-others is broker business.
- Distressed owner-occupant (30+ days delinquent or in foreclosure): you are likely an equity purchaser — written contract per §§6-1-1111/1112, seller cancellation right, full standstill.
- During the standstill: no deed, no recording, no transfer, no assignment, no payment.
- Structure distressed-owner deals to close, not to flip the paper.
