Is Wholesaling Legal in Florida?

No wholesale-disclosure statute — confirmed. The traps are brokerage law and the foreclosure-rescue statute, not wholesaling itself.

The information on this page is general information about the law, provided for educational purposes only. It is not legal advice, and reading it does not create an attorney-client relationship. The short answer

Common questions

Is wholesaling legal in Florida?

Yes. Florida has no statute requiring a wholesale-buyer disclosure, seller consent to assignment, or a seller cancellation right on an ordinary purchase contract. Assignment is contract language — draft your contract expressly assignable.

What is the real legal risk for Florida wholesalers?

Brokerage law. Your profit must be assignment consideration on your own contract — never a commission for connecting a seller and a buyer. An unlicensed brokerage fee is uncollectible (§475.41) and unlicensed brokerage is a third-degree felony (§475.42).

Can I offer a seller in foreclosure a leaseback or a chance to buy the house back?

That is the trap. §501.1377's equity-purchaser regime applies to foreclosure-rescue transactions where the seller keeps an interest. Wise Revival's standing rule: never offer a leaseback, stay, option, or repurchase to a seller in foreclosure.
